This Privacy Policy explains how Splurge Tech LLC ("Splurge," "we," "our," or "us") collects, uses, and shares information when you use splurge.bio. By using the platform, you agree to the practices described in this policy.

1. Information We Collect

1.1 Information You Provide

Account information: name, email address, username, bio, profile photo, social handles
Payment-related information: tip amounts, payout preferences (processed and stored by Whop — we do not store card or bank details)
Fan tip submissions: the display name a fan voluntarily attaches to a tip, and any optional message
Content: links, text blocks, and images you add to your profile
Communications: messages you send us via the contact form

1.2 Information Collected Automatically

Page views: creator profile views, referrer URL, device type (mobile/desktop)
Link clicks: which links on creator profiles are clicked
Country: estimated from IP address for creator onboarding (country selection for payout rails); IP address is not stored in analytics records
Cookies and local storage: used for authentication (Clerk), referral tracking (splurge_ref cookie), and analytics (PostHog)

1.3 Information from Third Parties

We receive limited information from our service providers. Clerk provides your authenticated identity. Whop provides payment status and payout information. We do not receive full payment card numbers or bank account details from any source.

2. How We Use Your Information

To operate and provide the platform — profiles, tipping, payouts, subscriptions
To communicate with you — tip notifications, payout confirmations, account updates
To enforce our Terms and Community Standards
To improve the platform through analytics
To process affiliate commissions
To comply with legal obligations

We do not sell your personal information. We share information in the following circumstances:

3.1 Service Providers

We share data with the following providers who process it on our behalf:

Clerk — authentication and session management
Whop — payment processing, creator payouts, KYC/identity verification
Resend — transactional email delivery
UploadThing — profile and link image hosting
PostHog — product analytics (data stored in the United States)
Railway / hosting infrastructure — database and application hosting

3.2 Public Information

Creator profile pages are public. Your username, bio, profile photo, links, and content blocks are visible to anyone. Tip leaderboard data (display name, tip amount) may be displayed publicly on a creator's profile if the creator has enabled leaderboard features.

3.3 Legal Requirements

We may disclose information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect rights, safety, or property.

4. Data Retention

We retain your account data for as long as your account is active. Tip and payout records are retained for a minimum of 7 years for financial record-keeping purposes. You may request deletion of your account through your dashboard settings, subject to retention requirements.

5.1 All Users

Access: you may request a copy of the personal data we hold about you
Correction: you may update your account information at any time through your dashboard
Deletion: you may delete your account through your dashboard settings

5.2 California Residents (CCPA)

California residents have additional rights under the California Consumer Privacy Act (CCPA):

The right to know what personal information we collect, use, share, or sell
The right to delete personal information we hold about you (subject to legal retention requirements)
The right to opt out of the sale of personal information — we do not sell personal information

Our lawful bases for processing include: performance of a contract (providing the platform), legitimate interests (security, fraud prevention, analytics), and compliance with legal obligations. Please note that PostHog analytics data is stored on servers in the United States. By using Splurge Bio, you consent to this transfer where applicable.

7. Children's Privacy

Splurge Bio is not directed at persons under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected information from a person under 18, we will delete it promptly.

8. Security

We implement industry-standard technical and organizational measures to protect your information. Payment card data is handled exclusively by Whop and its banking partners — we do not have access to full card numbers or bank account details. However, no online platform can guarantee absolute security.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you at least 30 days in advance via email or platform notice. Continued use of Splurge Bio after the effective date constitutes acceptance of the updated policy.
